Following the Fair Work decision earlier this month https://www.fwc.gov.au/documents/sites/awardsmodernfouryr/2018fwcfb4177.pdf, modern awards will be varied to provide employees with access to 5 days of unpaid family and domestic violence leave each year. These new rules take effect 1st August 2018.
The new entitlement applies to all employees covered by an industry or occupation based award. The leave also applies to all casual employees who are covered by an industry or occupation based award.
It doesn’t apply to employees who are:
- covered by Enterprise awards
- covered by State reference public sector awards
- covered by enterprise and other registered agreements
- award and agreement free
The leave can be taken by employees to deal with the impact of family and domestic violence. This includes (but isn’t limited to) taking time to:
- make arrangements for their safety, or the safety of a family member
- attend court hearings
- access police services
