The Unexplained Wealth Legislation Amendment Bill 2018 has been into Parliament. The Bill seeks to amend the Proceeds of Crime Act to give effect to the concept of unexplained wealth.
In order to do this the Bill proposes the following amendments:
- extend the Commonwealth’s concept of unexplained wealth restraining orders and unexplained wealth orders to the Australian Capital Territory and the Northern Territory, previously excluded from these arrangements.
- allows State and Territory agencies to access Commonwealth information gathering powers under the Proceeds of Crime Act for the investigation or litigation of unexplained wealth matters under State or Territory unexplained wealth legislation.
- support the effective operation of State and Territory confiscation regimes.
- make amendments to the Telecommunications (Interception and Access) Act to allow Federal, State and Territory law enforcement agencies to use, communicate and record lawfully intercepted information in relation to unexplained wealth investigations and proceedings.
